You have been assigned to Granite Creditors Service, Inc. because you have an unpaid account. This is not the end of the world! You have legal, ethical and human rights, and we at Granite respect that fact. Yes, our job is to collect the money that you legitimately owe your original creditor - but Life Happens. We know that, we understand that and we are here to help you through this situation to the best of our abilities.

So, what are your rights? What follows is a combination of moral and ethical rights that we at Granite respect.

  1. You have the right to be treated as a decent fellow human being.
  2. You have the right to be treated with honesty, courtesy and understanding.
  3. You have the right to ask questions and receive accurate and dependable answers.

Now for legal rights?

  1. You may not be called before 8AM and 9PM in your time zone.
  2. If you tell the collector that a certain time of day is not a good time to call you, the collector has to respect that, and honor your wishes. You work graveyard, you don't want early morning calls, tell us and we'll honor your request.
  3. A collector may legally call you at your place of employment. However, if you or the business owner requests no more calls, in writing by you or in writing or verbally by the employer, then communication by phone to your place of employment must end.
  4. You may also request that we not call you at all. At Granite, we will honor that request whether you make it verbally or in writing. As a caution we must tell you that if you request that we cease communications, potentially that could force our collection efforts into a lawsuit. You don't want that. We don't want that either.
  5. We at Granite can only contact your non-marital family members, neighbors, fellow employees and the like only to determine your location or for verification of your assets. Unless you specifically request that we contact another party that has no legal right to know about your debt for whatever reason is important to you, we will never disclose the existence of your debt to anyone other then you or your spouse. Ever.
  6. You have the right to dispute the debt. If you look at our Notice of Assignment you will see that your right to dispute - in writing - within 30 days is clearly disclosed. At Granite we make it easier: if you tell us you dispute the account we may ask you to send us documentation to help resolve the matter, but simply, if you dispute the account? It is our job to get the dispute resolved, hopefully to everyone's satisfaction. And we don't care if your dispute is in writing or verbal. We're here to help, not play legal games. The exact wording from Subsection 809(a)(3) of the Fair Debt Collection Practices Act, from 15 SC 1692g(a)(3) is "Within five days of the initial communication... a debt collector shall... send the consumer a written notice containing - "(c) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector."
  7. If you have an attorney and tell us that? Our communication ceases with you and commences with the attorney. If the attorney fails to respond in a reasonable period of time we will sever our communication with the attorney in writing and once again turn our attentions to you.
  8. We will never harass you. No postcards, no threats, no verbal attacks, no obscene language, no name-calling, no threats of suit (remember, please, that if we tell you litigation will begin, that is a statement of fact, not a threat), nothing misleading, false, no accusing you of breaking the law - no harassment. Period.
  9. We can legally report your collection account to all three national credit bureaus (Experian, Equifax and TransUnion). We will not report for the first 35 days after assignment from your original creditor. We also don't Have to report, and if we can reach a positive resolution with you? We won't. To repeat that - if we can reach a positive resolution with you? We won't.

Additionally, if you are a resident of California and believe or know that you've been a victim of Identity Theft - notify your local police department. "Under California Penal Code 530.5 the police are required to take a report if the victim lives within our jurisdiction. If it is determined that the crime occurred somewhere else we send the report to the appropriate agency.
